Terms of Service

These terms govern your use of the EventSpace platform. Please read them carefully before using our services.

1. Platform Description

EventSpace (“the Platform”, “we”, “us”, or “our”) is an online marketplace that connects individuals and organizations who have event-ready spaces (“Hosts”) with individuals or groups seeking to book those spaces for events (“Guests”).

We operate primarily in Ontario, Canada, and provide the technology platform, payment processing, messaging tools, and support services that facilitate bookings between Hosts and Guests.

EventSpace does not own, manage, or control any of the listed venues and is not a party to any agreement between Hosts and Guests.

EventSpace acts solely as a platform and does not act as an agent, partner, insurer, or employer of any Host or Guest. All transactions and interactions are solely between Hosts and Guests.

2. User Accounts & Eligibility

To create an account and use EventSpace, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your login credentials
  • Accept responsibility for all activity under your account
  • Not create multiple personal accounts
  • Not transfer your account to another party

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Host Responsibilities

Safety & Maintenance

Hosts agree to:

  • Maintain a safe, clean, and functional space
  • Provide working smoke detectors and emergency exits
  • Follow occupancy limits

Insurance & Compliance

Hosts must:

  • Maintain appropriate liability insurance
  • Comply with all local laws, permits, and bylaws
  • Follow food safety and accessibility regulations where applicable

Listing Accuracy

Hosts must:

  • Provide accurate descriptions, photos, and pricing
  • Disclose restrictions
  • Keep availability up to date

Legal Obligations

Hosts are responsible for:

  • Reporting income
  • Following Ontario regulations

4. Guest Responsibilities

Guests agree to:

  • Follow all Host rules
  • Respect the property
  • Not exceed guest limits
  • Leave the space in reasonable condition
  • Not engage in illegal activities

Guests participate in events and use venues at their own risk.

5. Bookings & Payments

Booking Process

A booking is confirmed once the Host accepts and payment is processed.

Fees

EventSpace charges service fees to Guests and commissions to Hosts, disclosed before booking. Current rates:

  • Guest service fee: 12% of the booking subtotal, added at checkout.
  • Host commission: 0% of the booking subtotal, deducted from payout.
  • Coordinator commission: 15% of coordinator service bookings, deducted from coordinator payout.
  • Featured listing boost: $49.00 for a 30-day placement at the top of search results.

EventSpace reserves the right to update these rates. Fees in effect at the time of booking apply to that booking.

Payment Role

EventSpace facilitates payment processing but is not responsible for the delivery or quality of services provided by Hosts.

Cancellation Policy

  • Flexible: Full refund if cancelled at least 24 hours before the event start time.
  • Moderate: Full refund if cancelled at least 5 days before the event. 50% refund if cancelled at least 48 hours before.
  • Strict: 50% refund if cancelled at least 7 days before the event. No refund for later cancellations.

The applicable cancellation policy is displayed on each listing and confirmed at the time of booking. Service fees may be non-refundable depending on the circumstances of the cancellation.

Refunds

Refunds are issued to the original payment method within standard processing times.

6. Security Deposits

Hosts may require a security deposit as part of their listing. If a security deposit applies, the amount is disclosed before booking and authorized (but not charged) at the time of payment.

The deposit may be charged in whole or in part if the Guest causes damage to the property, leaves the space in an unacceptable condition, or otherwise violates the terms of the booking.

Hosts must submit a damage claim with supporting evidence (photos, descriptions, receipts) within 48 hours of the event's conclusion. Guests will be notified and given 72 hours to respond before any deposit charge is finalized.

EventSpace may mediate deposit disputes at its discretion but is not liable for the outcome.

7. Limitation of Liability

Important Notice

EventSpace is a marketplace platform only.

We do not:

  • Own, operate, or inspect venues
  • Guarantee the quality, safety, or legality of any listing

To the maximum extent permitted by law, EventSpace is not liable for:

  • Injury, death, or property damage
  • Venue conditions or safety
  • Host or Guest conduct
  • Listing accuracy
  • Disputes between users
  • Indirect or financial losses

All use of the platform and participation in events is at your own risk.

EventSpace is not obligated to resolve disputes between users.

Our total liability is limited to the fees paid to EventSpace in the past 12 months.

8. Prohibited Activities

Users of EventSpace may not:

  • Use the platform for any unlawful purpose or in violation of any applicable laws
  • Create listings for properties they do not own or have authorization to list
  • Provide false, misleading, or deceptive information
  • Circumvent the payment system by arranging bookings or payments outside of EventSpace
  • Harass, threaten, discriminate against, or defame any other user
  • Use automated scripts, bots, or scraping tools to access or collect data from the platform
  • Interfere with or disrupt the platform's operation or security
  • Post spam, solicitations, or unauthorized advertising on the platform
  • Host events that exceed the stated venue capacity or violate local bylaws
  • Use the platform to promote or facilitate illegal drug use, underage drinking, or any other criminal activity

9. Content & Reviews Policy

User Content

Users retain ownership of content they post on EventSpace, including photos, descriptions, and reviews. By posting content, you grant EventSpace a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with operating and promoting the platform.

Reviews

Guests and Hosts may leave reviews after a completed booking. Reviews must be honest, accurate, and based on genuine experience. Reviews must not contain:

  • Defamatory, discriminatory, or hateful content
  • Personal information of other users
  • Content unrelated to the booking experience
  • Spam, advertising, or promotional material
  • False or misleading statements

EventSpace reserves the right to remove reviews that violate this policy. Reviews cannot be edited after 48 hours of posting.

10. Dispute Resolution

In the event of a dispute between a Host and Guest, we encourage both parties to first attempt to resolve the issue directly through the EventSpace messaging system.

If a resolution cannot be reached, either party may request mediation through EventSpace's internal dispute resolution process. Our team will review the facts, communications, and any submitted evidence before issuing a non-binding recommendation.

If the dispute remains unresolved after mediation, either party may pursue resolution through the courts of the Province of Ontario or through the Ontario Small Claims Court for eligible matters.

Class action lawsuits and class-wide arbitrations are not permitted under these terms. All claims must be brought in an individual capacity.

EventSpace may offer mediation at its discretion but is not responsible for enforcing outcomes.

11. Termination of Accounts

EventSpace may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion:

  • Violates these Terms of Service or any applicable law
  • Is harmful to other users, third parties, or EventSpace
  • Involves fraudulent, misleading, or deceptive activity
  • Involves repeated complaints from other users or community members

You may terminate your account at any time by contacting us. Outstanding bookings must be resolved before account deletion. Any pending payouts will be processed according to the standard payment schedule.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or related to these terms or your use of EventSpace shall be brought exclusively in the courts located in the Province of Ontario, Canada, and you consent to the jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Indemnification

You agree to indemnify and hold harmless EventSpace, its affiliates, and team from any claims, damages, liabilities, or expenses arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your interaction with other users
  • Any event you host or attend

15. Force Majeure

EventSpace is not responsible for delays or failures caused by events beyond our control, including natural disasters, government actions, or service interruptions.
